The Appeals Court of Kyiv has upheld the sentence of a man who cruelly killed a stray dog. Thus, the convicted individual will serve 7.5 years of imprisonment as per the decision of the first instance court.

The investigation established that the accused threw the dog down the stairs and then beat it with his feet, causing the animal’s death. The crime was committed in the presence of a minor child, which was considered an aggravating circumstance.

The first instance court found the man guilty of cruel treatment of an animal, committed actively in the presence of a minor, which led to its death (Part 3 of Article 299 of the Criminal Code of Ukraine), and sentenced him to 7.5 years of imprisonment.

The defense filed an appeal requesting to requalify the actions of the convicted under Part 1 of Article 299 of the Criminal Code of Ukraine (cruel treatment of an animal that led to its death) and to impose a sentence of two years of imprisonment. However, the prosecutors upheld their position, and the Kyiv Appeals Court left the sentence unchanged.
