The National Agency for the Detection and Management of Assets (ARMA) has announced the termination of the contract with the manager of the ‘Morshynska’ trademark – the company ‘Carpathian Mineral Waters’. The relevant statement was made on April 2.
This is reported by Kyiv24
The reason for the termination of the agreement was the company’s refusal to comply with the terms of the contract, which was caused by legislative restrictions regarding the need to coordinate actions with sanctioned individuals, including the owner of the seized asset. It was also noted that there has been a prolonged delay in obtaining permission for concentration from the Antimonopoly Committee of Ukraine.
“ARMA is already preparing the necessary documents and will announce a new competition tomorrow for the selection of an appraiser for the seized asset, ensuring a new relevant assessment with peer review. All interested parties who meet the qualification requirements will be able to participate in the selection,” the agency stated.
In addition, ARMA plans to initiate a competition for the selection of a new manager, which will start with gathering market consultations on the agency’s official website. After conducting an independent assessment of the asset, market consultations, and establishing criteria and qualification requirements, ARMA will publish information about the asset on the Prozorro platform.
It is worth noting that the corporate rights to the ‘Morshynska’ trademark, which were seized and transferred to ARMA for management, belong to the Russian oligarch Mikhail Fridman. He was also the owner of IDS Ukraine, which owns the brands ‘Morshynska’, ‘Mirgorodska’, and Borjomi.
ARMA has called on members of parliament to support draft law No. 10069, aimed at “enhancing the effectiveness of activities in the field of detection, search, and management of assets,” which, according to the agency, will allow for the unblocking of management of seized corporate rights.
Recall that in 2022, a Ukrainian court imposed a seizure on the assets of Russian oligarch Mikhail Fridman, including the Ukrainian subsidiary of IDS Borjomi International.
