In Kyiv, law enforcement has charged a surgeon from a private medical facility who performed breast augmentation on a woman despite her having been diagnosed with cancer. According to the investigation, the doctor ignored existing contraindications and failed to refer the patient for further examinations and a consultation with an oncologist.
Details of the Incident
The incident occurred in September of last year. The woman approached the capital’s medical center requesting breast correction surgery. During the pre-operative preparation, medical staff discovered a neoplasm in the area of the planned intervention. Despite this, the 30-year-old surgeon decided not to refer the patient for further diagnostics and did not involve specialized professionals for consultation.
“During the preparation of the patient, a series of examinations were conducted that revealed a neoplasm in the area of the planned surgical intervention. However, despite this, the 30-year-old surgeon did not refer the victim for additional diagnostics and consultation with an oncologist and proceeded with the surgery, disregarding the risks and existing contraindications,” the statement reads.
Consequences for the Patient and Doctor’s Responsibility
After the surgical intervention, the malignant tumor began to spread aggressively in the breast tissue, significantly worsening the woman’s health condition. Understanding the potential legal consequences of his actions, the surgeon attempted to evade responsibility by claiming he was receiving treatment in another region.
The doctor has now officially been charged under part 1 of Article 140 of the Criminal Code of Ukraine, which provides for liability for improper performance of professional duties by a medical worker due to negligence that led to serious consequences. The penalty for this article includes up to two years of imprisonment.
