Customs officials halted the import of a large batch of counterfeit toys to Kyiv

The Kyiv customs seized 12,800 children’s toys labeled “Pony in an Egg,” which were declared as “Assorted Children’s Toys.” The order was placed by a company from Kyiv, while the manufacturer was a firm from China.
Intellectual Property Rights Violations
During an intellectual property examination, it was determined that the images on the seized toys were so similar to the well-known trademark “My Little Pony” that they could cause confusion among consumers. The rights holder is the American company Hasbro, Inc., which produces the popular line of toys and children’s products.
“The results of the intellectual property examination established that the markings on the toys are similar enough to be confused with the well-known trademark ‘My Little Pony’.”

Legal Consequences for the Entrepreneur
Due to the identified violation, the customs clearance of the goods has been suspended. A protocol for a customs violation has been drawn up against the entrepreneur who attempted to move the counterfeit toys, in accordance with the article that provides for fines and confiscation of the goods.
