Recognition of the Arbitration Decision in Kazakhstan
The decision was made by the Court of the International Financial Center “Astana,” which recognized the arbitration ruling and allowed its enforcement in favor of Naftogaz. This is the first case where a foreign court has publicly recognized and permitted the enforcement of such a ruling against Gazprom within the territory of a separate state.
“The Court of the International Financial Center ‘Astana’ recognized the arbitration ruling and allowed its enforcement in the country in favor of the company.”
Naftogaz Chairman Serhiy Koretsky called this decision another practical achievement in collecting funds from Gazprom. He emphasized that the company is consistently working on enforcing the arbitration ruling in various jurisdictions and thanked the team for the achieved result.
Background of the Legal Dispute and Arbitration Decision
The case was initiated due to the transit of Russian gas, which Naftogaz organized for Gazprom under the Natural Gas Transportation Agreement signed in 2019. This agreement will remain in effect until January 1, 2025. After the onset of Russia’s full-scale aggression in May 2022, transit through the “Sokhranivka” entry point became impossible; however, Naftogaz continued to fulfill the contract terms through the “Sudja” point. At the same time, Gazprom refused to fully pay for the transit services.
In June 2025, the international arbitration tribunal in Switzerland ordered Gazprom to pay $1.37 billion to the Ukrainian company. Naftogaz emphasizes that since May 2022, the Russian company has violated the “take or pay” principle and ceased payments under the contract, which served as the basis for initiating arbitration proceedings in September 2022.
In March 2026, Naftogaz announced its final victory in the Swiss court, which solidified the company’s right to collect funds from Gazprom.
