The Kyiv City Prosecutor’s Office has filed a lawsuit to recover nearly 22 million hryvnias from a developer who constructed a residential complex on Berezhanska Street in the Obolon district of the capital.

Violation of Obligations Regarding Participation Fees
The developer, having built the residential complex, was obligated to transfer participation fees to the Kyiv budget for the development of urban infrastructure. However, as the prosecutor’s office notes, the company avoided fulfilling this financial obligation.
Legal Grounds for the Lawsuit
Participation fees for developers who received the corresponding obligations before January 1, 2021, remained mandatory. This circumstance is emphasized by the prosecutor’s office, highlighting that the obligation to pay the participation fee was canceled only from the beginning of 2021.
“It should be noted that the construction clients who had such an obligation before the cancellation of this payment are required to pay the participation fee for the development of the city’s infrastructure. It was canceled as of January 1, 2021,” the capital’s prosecutor’s office explained.
The court proceedings on this matter will determine whether the company is obligated to compensate the Kyiv budget for damages amounting to 22 million hryvnias.
