The Cabinet of Ministers has adopted a number of important decisions aimed at deregulating the construction sector and creating more favorable conditions for business. This was announced by the head of the government, Yulia Svyrydenko, emphasizing the beginning of systematic deregulation that is intended to facilitate entrepreneurial activities in the construction industry and speed up the country’s reconstruction process.

New mechanisms for construction clients

According to Svyrydenko, the government responded to numerous appeals from businesses regarding the need to reduce bureaucratic obstacles and implement clear, understandable rules in the construction sector. From now on, an experimental mechanism has been introduced that allows clients to choose where to obtain administrative services to start construction work: from local authorities (DABK) or from the State Inspectorate for Architecture and Urban Planning (DIAM). This approach provides an alternative and allows for faster processing of the necessary documents to initiate projects.

“The government is introducing an experimental mechanism — the construction client will be able to choose where to obtain administrative services, from the local authority (DABK) or from DIAM. The goal is to create an alternative in the system and expedite the receipt of documents,” Svyrydenko reported.

The ability to appeal refusals and further steps of the reform

In addition, the Cabinet has approved a mechanism for appealing refusals to provide urban planning conditions and restrictions. Now, in the case of a formal or unjustified refusal, the client can appeal to DIAM with a corresponding complaint. If the decision is deemed unjustified, the design process can continue in accordance with the requirements of urban planning documentation, eliminating the risk of project blockage due to bureaucratic formalities.

The government has also instructed the Ministry of Community and Territorial Development and the Ministry of Justice to urgently prepare a draft law that will establish clear deadlines for appealing construction decisions. According to the Prime Minister, these steps are part of a large-scale reform of urban planning, and the next stage will involve changes to legislation regarding spatial planning of communities and ensuring legal certainty in construction.

Svyrydenko also reminded that to ensure stable international financing, including the Ukraine Facility and IMF programs, Ukraine must continue to implement reforms, fulfilling its obligations to international partners.
