The government has changed the rules for reserving conscripts for enterprises and organizations

The Cabinet of Ministers has approved a new version of the rules for reserving conscripted employees of enterprises, institutions, and organizations that have the status of critical importance for the economy and stable functioning of the state during martial law.

Main changes in the reservation procedure

From now on, to confirm the status of a critical enterprise and the possibility of reserving employees, the average salary at the enterprise must be no less than 3 minimum wages, which amounts to 25,941 hryvnias. For companies operating in frontline areas, a more flexible approach applies – it is sufficient to ensure a salary at the level of 2.5 minimum wages, that is, 21,618 hryvnias. The list of such areas is determined by a separate order of the Ministry of Community Development, Territories, and Infrastructure.

“The adopted changes allow us to maintain a balance between defense needs and the stable operation of enterprises, without which the functioning of the economy is impossible in wartime,” said Minister of Economy Oleksiy Sobolev.

In addition, the government clarified the rules for considering employees in the reservation quota. From now on, employees who already have a deferment from conscription under Article 23 of the law “On Mobilization Preparation and Mobilization,” as well as part-time employees, are counted in the quota only for one of their workplaces. This decision is aimed at preventing artificial increases in the number of employees who can be reserved and linking the quota to the real staffing needs of the business.

Updating criticality criteria and further steps

Ministries, central executive authorities, and regional military administrations must review and reapprove their own criteria for the criticality of enterprises within a month, in agreement with the Ministry of Defense and the Ministry of Economy. This will allow for a more objective determination of whether an enterprise is truly important for the economy, defense capability, security, and meeting the basic needs of the population. In particular, factors such as the role of the enterprise in fulfilling state tasks, producing necessary products, supporting infrastructure, and employment will be taken into account.

Furthermore, the government plans to conduct a re-evaluation of the status of all enterprises that have already been designated as critical within three months after the changes come into effect.

It should be noted that since the full-scale invasion of Russia into Ukraine on February 24, a regime of martial law and general mobilization has been in effect.
