Two former officials of the Kyiv City State Administration to be tried for illegal construction in the ‘Nivky’ park

The investigation into the illegal transfer of part of the ‘Nivky’ park has been completed

Detectives from the National Anti-Corruption Bureau of Ukraine and the Specialized Anti-Corruption Prosecutor’s Office have submitted a case to the court concerning the illegal transfer of part of a state-designated natural reserve — the ‘Nivky’ park in Kyiv — for the construction of a residential-office complex.

Case circumstances and the role of officials

As the investigation revealed, in November 2019, the director of the Land Resources Department of the Kyiv City State Administration, who at the time also held the position of deputy head of the KCSA, was reviewing a land management project that proposed the construction on part of the ‘Nivky’ park. It is known that a similar project had been submitted for consideration in July of the same year, but it was sent back for revision because the land plot belonged to the natural reserve fund.

Despite this, the official ignored the existing information about the status of the plot. Using false data regarding the non-affiliation of the territory to the natural reserve fund, he submitted a draft decision to the Kyiv City Council that allowed the transfer of the plot for lease to a private company for construction purposes.

Consequences of illegal actions

As a result of these actions, the private company obtained the right to develop a plot of 0.6 hectares. This led to the loss of access to part of the park for the residents of Kyiv, and the city budget suffered damages amounting to nearly 6.4 million hryvnias.

Former officials of the KCSA, as well as the former head of the construction company, have been notified of suspicion under three articles of the Criminal Code of Ukraine.
