Scheme for Seizing Land Near Zaplavne Lake
Prosecutors have completed their investigation and submitted an indictment to the court against a resident of Kyiv who attempted to acquire ownership of a land plot within the nature reserve in the Darnytsia district. To implement her plan, the suspect used fake documents, with which she intended to develop the area that is part of the coastal protective zone of the Zaplavne Lake landscape reserve.
Forged Documents and Attempt to Legalize the Seizure
According to the investigation, initially, ownership rights were registered for a non-existent house on the plot. Subsequently, under the pretext of this “house,” a land plot was formed and assigned a cadastral number. Such actions, in the opinion of the prosecutors, indicate preparation for further formalization of ownership rights to the land.
“Initially, ownership rights were registered for a house that never actually existed on this plot. Later, a land plot was formed under this house, which was assigned a cadastral number. Such actions indicate the owner of the ‘house’ was preparing to further obtain rights to the land plot,” the prosecutors noted.
Subsequently, the woman began construction on the seized territory to confirm the existence of a real estate object and secure her ownership rights to the land. In this way, she attempted to conceal her criminal intent.
Investigators classify the actions of the suspect under Article 197-1 of the Criminal Code of Ukraine (unauthorized construction on illegally occupied land within the nature reserve) and under Article 358 of the Criminal Code of Ukraine (forging and using forged documents). The maximum penalty for these offenses is up to five years of imprisonment.
