The owner of the construction company attempted to annul the Kyiv City Council’s decision to create the landscape reserve “Protasiv Yar,” citing the right to lease one hectare of land in this area.

The Court Upheld the Decision on the Reserve
The Economic Court of Kyiv dismissed the lawsuit of the economic society that sought to annul the Kyiv City Council’s decision regarding the establishment of the local significance landscape reserve “Protasiv Yar.” Company representatives claimed their rights to the land, as they had leased over 1 hectare in the area and planned large-scale construction.
Arguments of the Environmental Prosecutor’s Office
During the proceedings, the environmental prosecutor’s office proved that the lease agreement cited by the construction company had expired more than ten years ago. Prosecutors emphasized that any construction within the reserve area is unacceptable, as it could lead to the loss of a unique natural complex, the destruction of species listed in the Red Book of Ukraine, and damage to archaeological heritage.
“The company claimed to be the user of over 1 hectare of land in the area and planned large-scale construction. Environmental prosecutors proved in court that the lease agreement for this land had been terminated more than ten years ago. They insisted that any construction within the protected zone is unacceptable, as it would result in the loss of a unique natural complex, the destruction of species listed in the Red Book of Ukraine, and harm to archaeological heritage,” the statement reads.
The court supported the position of the Specialized Environmental Prosecutor’s Office and upheld the Kyiv City Council’s decision to create the landscape reserve “Protasiv Yar.”
