The construction of a residential complex on Vylshanska Street is ongoing despite multiple cancellations of permits

In the Pechersk district of Kyiv, in close proximity to the National Botanical Garden, the construction of the residential complex “OZON Concept House” is underway. The building is located just 350 meters from the botanical garden and falls within the protected area of the “Dnieper Valley,” where, according to the Historical and Urban Planning Plan of the capital, the maximum height of buildings should not exceed 27 meters, which corresponds to approximately eight floors.
The Construction Contradicts Urban Planning Restrictions
The new project involves the construction of residential buildings up to 24 stories high, which is nearly three times the allowable limits for this area. The construction site is located on Vylshanska Street and has been the subject of numerous disputes between developers and city authorities.
“The residential complex ‘OZON Concept House,’ being built 350 meters from the National Botanical Garden at the request of Andriy Vavrysh’s company, will be three times higher than permitted by the Historical and Urban Planning Plan of Kyiv.”
Permits Were Canceled Several Times, But Work Resumed
Over the past 12 years, the State Architectural and Construction Inspection and city authorities have canceled construction permits for this site three times. In particular, in May 2018, the Kyiv City Council, responding to the demands of local residents, made a decision to create a park in this area. However, the developer challenged this decision in court and succeeded in having it overturned.
In early November 2025, the development division of BGV Group, at the request of Saga Development, resumed work on the construction of a 24-story residential complex with 1,088 apartments.
