The construction of a restaurant in the capital’s park has been deemed illegal

An illegally constructed restaurant building has been discovered in Taras Shevchenko Park in the center of Kyiv. According to law enforcement, the structure appeared on land that belongs to Ukraine’s natural reserve fund and is protected as a national treasure.
The Prosecutor Demands the Land Be Returned to the Community
The Shevchenkivskyi District Prosecutor’s Office has filed a lawsuit demanding the cancellation of the property registration for the restaurant, which covers nearly 500 square meters, the demolition of the building, and the return of the land plot, measuring 0.0567 hectares, to the territorial community of the city. The area where the restaurant is located is a local significance park-monument of garden and park art, “T.G. Shevchenko Park,” which has a special regime for use and protection.
“The Shevchenkivskyi District Prosecutor’s Office of Kyiv is legally demanding the cancellation of the property registration for the restaurant building, which covers nearly 500 square meters, its demolition, and the return of the land plot measuring 0.0567 hectares to the capital’s territorial community,” the statement reads.
Legal Prospects of the Case
Law enforcement has established that the construction of the restaurant and the registration of property rights occurred in violation of current legislation. Any activities unrelated to the direct functions of the park are prohibited in this area, as well as the placement of any buildings or structures.
The Economic Court of Kyiv has already opened proceedings based on the prosecutor’s lawsuit. A preparatory court hearing is expected to take place soon, during which the legality of the restaurant’s construction and the possibility of its demolition will be considered.
